Medical Malpractice

In 1997, the firm recovered a substantial settlement for a mother and child who contracted AIDS from a defective blood transfusion given in 1983. Premises Liability

Crossing Accidents

Many of this country’s railroad crossings are unprotected and dangerous to motorists, pedestrians and railroad employees. The crossings that do have lights or crossbucks are often poorly maintained or non-functional. A train cannot stop quickly or swerve, all it can do is sound the whistle, slow down and provide plenty of warning. We have successfully represented motorists, pedestrians and trainmen for the injuries they’ve sustained related to dangerous crossings.

Case Study: Increasing the Recovery for Engineers

An Amtrak engineer with a fully-loaded, recently fueled train had just gotten up to speed after leaving the station, when he saw a Ford Mustang drive around the crossing gates ahead. When the train inevitably hit the Mustang, somehow it snagged the front end, causing the car to repeatedly crash into the side of the train by the fuel tanks, with sparks flying everywhere. While the train slowly ground to a halt, the engineer had nightmarish visions that the train would burst into flames, burning the passengers. The post-traumatic stress disorder he developed totally disabled him from working.

Instead of pursuing recovery from the railroad, which basically was not at fault for causing the accident, Faerber & Anderson obtained the limited insurance available from the Mustang driver, and then obtained a very substantial recovery under the engineer’s underinsured motorist coverage. Faerber & Anderson creatively used insurance policy law to increase the recovery for the railroad engineer where otherwise it might have been very limited to almost nothing.

Pedestrians

Oftentimes, pedestrians don’t appreciate the dangers associated with trains that are stopped on railroad tracks - these may be “live” trains that can move suddenly, without warning. Other pedestrian crossing accidents occur when people get “caught” on or near the railroad track, with no place to escape an oncoming train. Many of these type of accidents occur near parks or on well-travelled paths, which the railroads clearly know are present. Faerber & Anderson have successfully pursued these types of cases against the railroads, pushing for stronger safety measures, warnings and education to be implemented.

Auto accidents - Improperly maintained signals or track

Many times crossing accidents involving an automobile occur at unprotected crossings, where foliage and terrain can make it difficult to see the approach of an on-coming train. Signals and crossbucks can malfunction from lack of maintenance. The track at some crossings is so deteriorated, multiple accidents have occurred when vehicles get stuck.
